Jean Bart, or Jambarl, doesn't stand out as much as the other members of the Heart Pirates, as odd as it is to say (when the other members are a man who can cut people into pieces and manipulate their body parts, and a karate bear, it's difficult to stand out if you have no distinct qualities aside from looking like a demon). Meanwhile, Magellan was a large source of humour early on in the arc due to the interactions between him and Hannyabal, which pushed both of them up in my eyes, and he is one of the three opponents that Luffy has faced where he has been unable to fight back afterwards (the other two being Aokiji and Kuma during Shabondy), so I will vote for Magellan.

Meh, kind of a "lesser of two" thing again... and I really don't like Magellan because:

1. He almost killed Luffy
2. He is badly mistreating Ace (hey, can't you at least treat your prisoners with a little more dignity, ESPECIALLY if you intend to give them capital punishment?!)

Thus I voted to Jambarl, the former slave. Don't really know much else about him aside from the fact he's a Heart Pirate.

Maybe (you're right that we don't know for sure), but Magellan DID still try to kill Luffy... and nearly succeeded. I think that's enough right there to sway my vote towards the other.

He's chained up pretty tightly and still pretty wounded. Plus considering the state of his vivre card, he's not going to be attempting a runaway by himself any time soon.
