Sure he was involved in Arlong's death, but he also wasn't the sole cause of it either.
Assuming Arlong is dead of course. You must have noticed how Oda generally likes to get rid of major villains in ways which they simply don't need to be dealt with again. Yet aside from Roger, we've never heard about a formal execution in modern day.

Well, technically, Kuro was "executed" even if it was an imposter. There have also been a good deal of attempted executions. Zoro was going to be executed, as well as Hiruluk. So I guess we just haven't heard of a successful modern day execution. Those wacky marines

Good point on Kuro! I hadn't thought about that!!!! Zoro kinda gets an excuse though since he was, you know, at the hands of a renegade screw-loose ^O^

Just out of curiosity, where did Oda say that Luffy hasn't killed anyone? I'd like to know what the source on this is.

    SBS:
Q: Why doesn't Luffy ever kill his enemies? I reread all the manga and he didn't kill Mohji, and he didn't Helmeppo or Captain Morgan, althougth Morgen was done by Zoro. Why is that?

Oda Answers: Good question. Frist of all, Captain Morgen is still alive. He was captured by his former man and thrown in the brig. The reason Luffy doesn't kill is this: in his era, man live by thier beliefs and risk thier lives to defend them. Luffy shatters the beliefs of his enemies by defeating them. For them to suffer defeat and to have thier beliefes destroyed is as bad as death. Killing thier bodies is beside the point. I feel that, as pirates, Luffy and his enemies care more about victory and defeat then they care about thier lives.
